Terms of Service for BlessSoul

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the BlessSoul mobile application ("App," "Service," or "BlessSoul"), developed and operated by Praveena H D, a sole proprietor and individual developer based in Shivamogga, Karnataka, India ("we," "our," or "us").

BY CREATING AN ACCOUNT OR USING BLESSSOUL, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, do not use the App.


1. Solo Developer Disclosure and Limitations

1.1 One-Person Operation

IMPORTANT DISCLOSURE: BlessSoul is developed, operated, and maintained by one individual developer. This means:

4. Account Access and Data Retention

4.1 Active Subscription

If your subscription expires and is not renewed:

Day 0-29 (Grace Period):
- Your account enters Read-Only Mode
- You can view all your existing data but cannot create or edit content
- You'll see prompts encouraging you to resubscribe
- Your data remains secure and accessible

Day 30 (Final Day - Account Deletion):
- Your account will be automatically and permanently deleted
- All data is irreversibly removed (cannot be recovered)
- This includes: goals, diary entries, schedules, manifestations, reminders, and all user-generated content

Important: You will receive email notifications warning you of expiration and upcoming deletion. Resubscribing at any time before day 30 restores full access immediately.

By You (Manual Deletion):
- You may delete your account at any time through Settings → Data Management → Delete Account
- Important: You cannot delete your account while a subscription is active - you must cancel your subscription first through Apple
- If you have an expired subscription in the grace period, you CAN delete your account
- Account deletion is immediate and permanent
- All your data will be irreversibly deleted across all platforms:
- Supabase database
- Apple iCloud/CloudKit
- Local device storage
- Encryption keys (Keychain)
- Backups are purged within 30 days
- This action cannot be undone - data cannot be recovered
- A confirmation email will be sent to your registered email address
- Deleting your account does NOT automatically cancel your Apple subscription - you must cancel separately through Apple ID settings

By Us (Termination):
- We reserve the right to suspend or terminate your account if you violate these Terms
- We may terminate accounts that violate acceptable use policies
- We will provide notice before termination unless prohibited by law or if immediate action is required for security
- Terminated accounts may be prohibited from creating new accounts

Automatic Deletion:
- Accounts are automatically deleted 30 days after subscription expiration without renewal
- You will receive multiple email warnings before automatic deletion
- Automatic deletion can be prevented by resubscribing before day 30


6. AI-Generated Content Disclosure and Disclaimers

6.1 AI Content Generation

CRITICAL DISCLOSURE: Daily quotes and inspirational content in BlessSoul are generated by Claude AI, an artificial intelligence system developed by Anthropic, Inc.

YOU ACKNOWLEDGE AND AGREE THAT:

WE PROVIDE NO WARRANTIES REGARDING:

AI-GENERATED CONTENT IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ORIGINALITY, ACCURACY, OR NON-INFRINGEMENT.

6.3 Quote Sharing and User Responsibility

If you choose to share, save, or distribute quotes from BlessSoul:

BY SHARING QUOTES FROM BLESSSOUL, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Praveena H D from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

6.5 DMCA Safe Harbor and Takedown Procedure

We comply with the Digital Millennium Copyright Act (DMCA) and maintain safe harbor protections.

If you believe content in BlessSoul infringes your copyright:

  1. Send a DMCA notice to: support@blesssoul.com
  2. Include:
  3. Description of the copyrighted work claimed to be infringed
  4. Location of the infringing material in the App (specific quote text)
  5. Your contact information (name, address, phone, email)
  6. Statement of good faith belief that use is not authorized
  7. Statement under penalty of perjury that the information is accurate
  8. Your physical or electronic signature

We will:
- Investigate claims promptly (within 5-10 business days, subject to solo developer resources)
- Remove infringing content if claim is valid
- Notify users if their shared content is removed
- Maintain records of takedown requests

LIMITATIONS:
- As a solo developer, response may take up to 10 business days
- We cannot pre-screen all AI-generated content
- Removal applies to future generation; we cannot recall quotes already saved by users to their devices

6.6 Fair Use Defense

To the extent permitted by law, we assert fair use defenses including:

IMPORTANT: Due to the volume of AI-generated content and solo developer resource constraints:

- Does not grant you ownership of any part of the App

8.4 AI-Generated Content Intellectual Property

Regarding AI-generated quotes:
- We do NOT claim copyright ownership of AI-generated quotes
- We do NOT grant you any intellectual property rights to quotes
- Quotes may be subject to third-party intellectual property rights
- You use quotes at your own risk (see Section 6)


9. Data and Privacy

BlessSoul is distributed exclusively through Apple's App Store. Your download, purchase, and use are subject to Apple's App Store Terms of Service and Apple Media Services Terms and Conditions.

The App uses the following third-party services to provide functionality:

  2. Firebase (Google): Analytics and crash reporting (production builds only)
  3. Google Sign-In: Optional authentication method
  4. RevenueCat: Subscription management
  5. Apple iCloud (CloudKit): Backup and sync across devices (optional)
  6. Resend: Email delivery for account-related emails
  7. Apple App Store: Payment processing
  8. Claude AI (Anthropic): AI-generated quotes and inspirational content

Your use of these services is subject to their respective terms and privacy policies (links provided in our Privacy Policy).

- Any claims arising from your sharing, use, or distribution

YOU AGREE TO INDEMNIFY US: By sharing quotes from BlessSoul, you agree to indemnify, defend, and hold harmless Praveena H D from ANY and ALL claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your sharing, distribution, or use of AI-generated quotes
- Copyright infringement claims related to quotes you shared
- Intellectual property disputes arising from content you distributed
- Any commercial use of quotes from the App
- Your failure to verify or properly attribute quotes

STRONG RECOMMENDATION: Use quotes for personal inspiration only. Do NOT use for commercial purposes without independent verification and proper permissions.

21.5 NO LIABILITY FOR AI CONTENT ISSUES

We are NOT liable for:
- Copyright infringement claims arising from AI-generated content
- Inaccuracies or errors in quotes, templates, or descriptions
- Inappropriate or offensive AI-generated content
- Reliance on AI content for any important decisions

15. iOS Permissions

15.1 PERMISSIONS WE REQUEST

BlessSoul requests the following iOS permissions to function properly:

1. Photo Library (Add Photos Only):
- Purpose: Save quote images you create to your Photos app
- Required for: Quote sharing and saving features
- What we access: NOTHING - this is write-only permission
- What we do: Save images you explicitly choose to save
- You control this: Settings → Privacy & Security → Photos → BlessSoul

2. Photo Library (Read Photos - Limited):
- Purpose: Select a single photo for your profile picture
- Required for: Profile customization feature
- What we access: ONLY the single photo you explicitly select
- What we do: Upload your chosen photo to set as profile picture
- We do NOT: Scan, browse, or upload your full photo library
- You control this: Settings → Privacy & Security → Photos → BlessSoul

3. Push Notifications:
- Purpose: Send reminders, goal alerts, schedule notifications, and inspirational quotes
- Required for: Reminder functionality and daily quote delivery
- What we send: Notifications you configure (reminders, schedule alerts, daily quotes)
- You control this: Settings → Notifications → BlessSoul

15.2 WHAT WE DO NOT ACCESS

BlessSoul does NOT request or access:
- ✗ Full photo library (only single photo you select for profile)
- ✗ Camera (no photo/video capture)
- ✗ Microphone (no audio recording)
- ✗ Location (GPS or network location)
- ✗ Contacts (address book)
- ✗ Calendar (beyond our own schedule data)
- ✗ Health data (HealthKit)
- ✗ Motion & Fitness activity
- ✗ Bluetooth
- ✗ Home data
- ✗ Media Library

Your privacy is important to us. We request only the minimum permissions necessary for core functionality.


16. Notification Disclaimer

16.2 NOTIFICATION DEPENDENCIES

Notification delivery depends on factors outside our control:

- Device settings (Do Not Disturb, Focus modes)
- Network connectivity (Wi-Fi or cellular)
- Device battery status
- iOS notification permissions
- Device storage space
- Background app refresh settings
- iOS system updates or changes

Any of these factors may prevent or delay notification delivery.

16.3 YOUR RESPONSIBILITY

For important events, you should:
- Use multiple reminder systems (calendar, alarms, other apps)
- Set backup reminders through iOS Clock app
- Do NOT depend solely on BlessSoul for critical reminders
- Use device alarms for time-sensitive events

NO LIABILITY: We are NOT liable for missed notifications, late notifications, failed delivery, or ANY consequences resulting from notification issues, including but not limited to: missed appointments, late medications, missed deadlines, lost opportunities, or any other damages.

Use notifications at your own risk. This is a convenience feature, not a guaranteed service.

18.3 Maximum Liability Cap - ULTRA-PROTECTIVE

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IS STRICTLY LIMITED AS FOLLOWS:

Per-User Liability Cap:
- For paid subscribers: Our total liability shall NOT exceed the amount you actually paid for your current subscription period
- Monthly subscribers: Maximum ₹1,000 (approximately $12.99 USD equivalent)
- Quarterly subscribers: Maximum ₹2,500 (approximately $29.99 USD equivalent)
- Yearly subscribers: Maximum ₹8,000 (approximately $99.99 USD equivalent)
- For free trial users: Our total liability is ₹0 (ZERO) - no liability whatsoever

Aggregate Liability Cap (All Users Combined):
- Our total aggregate liability to ALL users combined shall NOT exceed ₹1,00,000 INR (One Lakh Indian Rupees) per calendar year
- This cap applies regardless of the number of claims, users, or circumstances

Excluded Damages:
- We are NOT liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
- We are NOT liable for loss of data, profits, revenue, business opportunities, goodwill, reputation, or use
- We are NOT liable for service interruptions, errors, security breaches, or data loss
- We are NOT liable for third-party actions, content, or services (including AI-generated content issues)
- We are NOT liable for copyright infringement claims arising from AI-generated quotes you share or use
- We are NOT liable for emotional distress, personal injury, or any harm arising from app use

Application of Caps:
- These liability caps apply even if we have been advised of the possibility of damages
- These caps apply even if we are found negligent, grossly negligent, or at fault
- These caps apply regardless of the legal theory (contract, tort, strict liability, etc.)
- These caps apply to all claims arising from or related to your use of BlessSoul
- These caps apply to claims arising from health advice, financial advice, manifestation methods, AI content, notification failures, mental health features, and any other app features

Solo Developer Protection:
- Given this is a one-person operation with limited resources and income, these caps are essential and reasonable
- A single large judgment could bankrupt the developer and end the service for all users
- By using BlessSoul, you accept these limitations as fair and appropriate for a solo developer app

Jurisdictional Variations:
- Some jurisdictions do not allow limitations on implied warranties or exclusions of liability
- To the extent prohibited by applicable law in your jurisdiction, the above limitations may not apply
- However, to the fullest extent permitted by law, the liability caps remain in effect

We are not liable for delays, failures, or inability to perform due to circumstances beyond our reasonable control, including but not limited to:

Solo Developer Force Majeure:
Given this is a one-person operation:
- Service may be unavailable during developer illness or personal emergencies
- Updates and support may be delayed during unforeseen circumstances
- Users accept these risks inherent to a solo developer service
- We will communicate outages when possible, but cannot guarantee notice


19. Indemnification

19.1 User Indemnification

You agree to indemnify, defend, and hold harmless Praveena H D, and any affiliates, contractors, or service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and costs) arising from or related to:

21. Governing Law and Dispute Resolution

21.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Specific Jurisdiction: The laws of the State of Karnataka, India shall apply.

NO US LAW: These Terms are NOT governed by California law, United States law, or any other foreign jurisdiction law. Indian law exclusively applies.

21.2 Exclusive Jurisdiction

CRITICAL - INDIAN JURISDICTION WITH MANDATORY CONSUMER RIGHTS EXCEPTIONS:

General Rule (Non-Consumer Users):
- All disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Shivamogga, Karnataka, India
- You hereby irrevocably consent to the exclusive jurisdiction of these courts
- You hereby waive any objection to venue or jurisdiction in Shivamogga, Karnataka, India
- NO INTERNATIONAL ARBITRATION: Disputes shall NOT be resolved through international arbitration

EXCEPTION for EU/UK/Swiss Consumers:

Nothing in this section removes your right as a consumer in the European Economic Area, United Kingdom, or Switzerland to bring proceedings in the courts of your country of residence, as required by:
- EU Regulation 1215/2012 (Brussels I Regulation - Recast)
- Equivalent UK and Swiss law

For EU/UK/Swiss consumer disputes:
- You may bring claims in either (a) courts of Shivamogga, Karnataka, India, OR (b) courts of your country of residence
- We may only bring claims against you in courts of your country of residence
- This does not waive our other protections (mediation, fee shifting within your jurisdiction, liability caps)

EXCEPTION for California Consumers:

Nothing in this section waives rights provided by the California Consumer Legal Remedies Act or other mandatory California consumer protection laws that cannot be waived by contract.

For All Other Users:
- Exclusive jurisdiction remains in Shivamogga, Karnataka, India
- No exceptions apply
- All mandatory procedures (mediation, etc.) apply

Why Shivamogga, Karnataka?
- This is the developer's home location
- Ensures affordable access to legal system for solo developer
- Prevents financial burden of defending claims in foreign jurisdictions
- Protects developer from frivolous lawsuits filed in expensive foreign courts
- Exceptions above preserve mandatory consumer rights while protecting solo developer

21.3 Mandatory Mediation Before Litigation

BEFORE filing any lawsuit, YOU MUST:

  1. Contact us for informal resolution:

  4. Allow 60 days for good-faith informal resolution attempts
  5. Most disputes can be resolved quickly and amicably through communication

  8. Mediation shall be conducted in Shivamogga, Karnataka, India
  9. Mediation shall be conducted in English or Kannada
  10. Each party bears their own mediation costs

Consequence of Non-Compliance:

- You may be responsible for our legal costs incurred defending improperly filed claims

21.4 Fee Shifting - Loser Pays

IMPORTANT COST CONSEQUENCE:

What this means for you:
- If you sue and lose, you pay our legal costs (in addition to your own)
- If you sue and win, we pay your legal costs
- If we sue you and lose, we pay your legal costs
- If we sue you and win, you pay our legal costs

Solo Developer Protection:
- This clause protects a solo developer from being bankrupted by defending against frivolous claims
- Even if we win a frivolous lawsuit, legal costs could be devastating without fee recovery
- By using BlessSoul, you agree this protection is fair and reasonable

21.5 Frivolous Lawsuit Penalty

PENALTY FOR BAD-FAITH LITIGATION:

If any court determines that you filed a lawsuit that is:
- Frivolous (lacking legal merit)
- Brought in bad faith
- Intended to harass or burden the developer
- Filed in violation of these Terms (e.g., wrong jurisdiction, no mediation)

YOU AGREE TO PAY A PENALTY OF ₹50,000 INR (Fifty Thousand Indian Rupees) to the developer, in addition to:
- All legal fees and costs (per Section 21.4)
- Any damages awarded
- Any other remedies available to the developer

Purpose: Protects solo developer from malicious or harassing litigation that could destroy a one-person business.

21.6 No Class Actions

CLASS ACTION WAIVER:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY and NOT as part of a:
- Class action lawsuit
- Class arbitration
- Representative action
- Collective action
- Mass action

You waive any right to:
- Participate in a class action against BlessSoul
- Act as a class representative
- Act as a private attorney general
- Consolidate your claim with other users' claims

Each user may only bring claims individually.

If this class action waiver is found to be invalid or unenforceable, the entire dispute resolution provision (Section 21) shall be null and void, but the rest of these Terms remain in effect.

Purpose: Protects solo developer from existential threat of class action lawsuits, which could bankrupt a one-person operation even if meritless.

21.7 Waiver of Foreign Jurisdiction

EXPLICIT WAIVER:

By using BlessSoul, you explicitly and irrevocably waive any right to:
- Sue in United States courts (federal or state)
- Sue in California courts
- Sue in courts outside India
- Invoke jurisdiction based on your location
- Claim inconvenience of Indian jurisdiction
- Seek removal to foreign courts

You acknowledge:
- You are entering into a contract with an Indian developer
- Indian jurisdiction is appropriate and expected
- You accept the inconvenience (if any) of Indian jurisdiction as a condition of using the Service
- This waiver is knowing, voluntary, and informed

21.8 Small Claims Exception - REMOVED

THERE IS NO SMALL CLAIMS COURT EXCEPTION.

21.9 Limitation Period

If any court finds any provision of Section 21 (Dispute Resolution) to be invalid or unenforceable:
- The invalid provision shall be severed

21.11 Mandatory Consumer Protection Rights

Preservation of Statutory Consumer Rights:

Nothing in these Terms limits, excludes, or restricts your statutory rights as a consumer under applicable mandatory consumer protection laws that cannot be waived by contract.

Applicable Consumer Protection Laws:

If you are a consumer in a jurisdiction with mandatory consumer rights, those rights apply in addition to these Terms, including but not limited to:

India: Consumer Protection Act, 2019 - Right to redressal, right to be heard, right to seek compensation, right to be informed, right to choose, right to consumer education

European Union: Consumer Rights Directive (2011/83/EU) - Right to withdraw from distance contracts (14 days), right to clear information, right to remedies for defective digital content

United Kingdom: Consumer Rights Act 2015 - Rights regarding digital content quality, unfair terms protection, right to repair/replacement/refund

Other Jurisdictions: Mandatory consumer protection laws in your country that cannot be contractually waived

In Case of Conflict:

If any provision of these Terms conflicts with mandatory consumer protection laws in your jurisdiction, the mandatory consumer protection laws shall prevail to the extent of the conflict. All other provisions of these Terms remain in full force and effect.

- Apply to digital services provided internationally

22. General Provisions

22.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and Praveena H D regarding BlessSoul and supersede all prior agreements, communications, and understandings.

22.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Protection of Core Terms:
If any of the following core protections are found invalid, the developer reserves the right to terminate the Service rather than operate without these protections:

By using BlessSoul, you consent to receive communications from us electronically, including via email or in-app notifications. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

22.9 Relationship

These Terms do not create any agency, partnership, joint venture, employment, or franchisee relationship between you and us.

22.10 Third-Party Beneficiaries

NO THIRD-PARTY BENEFICIARIES:

Except for Apple (as required by Apple's App Store terms), there are no third-party beneficiaries to these Terms. No third party may enforce any provision of these Terms.

25. Acknowledgment and Acceptance

26. Apple-Specific Requirements

26.1 Acknowledgment

You acknowledge that:
- These Terms are between you and Praveena H D, not Apple
- Apple is not responsible for BlessSoul or its content
- Apple has no obligation to provide maintenance or support for BlessSoul
- Apple is not responsible for addressing any claims relating to BlessSoul, including:
- Product liability claims
- Claims that BlessSoul fails to conform to legal or regulatory requirements
- Claims arising under consumer protection or similar legislation

26.2 Intellectual Property Claims

In the event of a third-party claim that BlessSoul infringes intellectual property rights:
- Praveena H D (not Apple) is responsible for investigation, defense, settlement, and discharge of the claim

26.3 Apple as Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

26.4 License Scope

The license granted in Section 8.3 is limited to a non-transferable license to use BlessSoul on Apple-branded products that you own or control, as permitted by the Apple App Store Usage Rules.
